El propósito que guiaba a Bodin al escribir Los seis libros de la República era el de sentar las bases para un estudio teórico de la política, descuidada hasta entonces pese a ser la «princesa de todas las ciencias». El propio Bodin compara su empresa a la llevada a cabo, dos mil años antes, por los maestros de la Grecia clásica, si bien su referencia a las obras de Platón y Aristóteles está cargada de sentido crítico. Es preciso, (...) en primer lugar, que la nueva teoría política se haga cargo de todas las enseñanzas suministradas por la experiencia humana acumulada durante tan prolongado período histórico. En segundo lugar, es necesario romper el velo de «tinieblas muy espesas» que ocultaban aún, en aquellos tiempos, los «misterios sagrados de la filosofía política». Sólo si se procede así será posible, por un lado, colmar las lagunas que nos legaron filósofos tan venerables y, por otro, evitar los graves errores cometidos por quienes, después, han escrito alegremente sobre los asuntos políticos y que son culpables, sobre todo, por no haber tenido «ningún conocimiento de las leyes y, ni siquiera, del Derecho público». Il s'agit de la première édition de cette oeuvre majeure de Bodin. Jusqu'ici seul le texte latin était disponible (éd. L. Noak, 1857), ou la traduction anglaise de 1975, par Mrs. Kuntz. Le texte donné ici est celui d'une traduction française anonyme écrite très tôt après la mort de l'auteur (1596), dans une langue proche de celle de la République. Bodin fait ici converser sept sages, un juif, un musulman, un catholique romain, un luthérien, un calviniste, un adepte (...) de la religion naturelle et un "ethnique" (indien d'Amérique) à propos des mérites de leurs religions respectives. Loin de donner l'avantage au christianisme, il semble montrer une certaine inclinaison au judaïsme qui fera les délices des libertins du XVIIe siècle... (shrink)

This article presents Jean Bodin’s critic to the juridic approach of the laws and the idea of justice in his time. Firstly, it presents Bodin’s opposition to the glossators of the Roman Law. Secondly, it defends that Bodin considers the method as a tool that could make it possible to achieve an exact knowledge of the principles of the law. Finally, it deals with Bodin’s approach to the knowledge of the law as scientific knowledge. Jean-Jacques Rousseau devoted an important chapter of his Social Contract to the dictatorship. Carl Schmitt interpreted Rousseau’s chapter as marking the transition from ‘commissarial’ to ‘sovereign dictatorship’. This article argues that Schmitt’s interpretation is historically and conceptually inaccurate. Instead of paving the way for sovereign dictatorship, Rousseau carefully distinguished the dictatorship from the people’s sovereign authority. Taking position in the ‘debate’ between Bodin and Grotius on the relation between dictatorship and sovereignty, he argued that the dictator could provisionally (...) suspend the people’s sovereign authority, but not abolish it. More particularly, the dictator did not possess the power to make generally binding laws, which had to remain the exclusive authority of the popular assembly. However, this did not prevent Rousseau from recognizing the dictatorship as a means for democratic reform. Rousseau thus conceived of the dictatorship as a time-limited and revocable commission to protect the constitution and to provide for a more stable and effective state organization based on the principle of popular sovereignty. Although the self is distinct from identity, this essay offers some insight into how identity is maintained—in the processes by which a self is formed, and through the actual content of the schemata that compose the self-concept. The author explains how in the 1920s utopian representations of a “new man” indicate the blank space where an aesthetic for the self can appear long before a theory of choice and commitment can exist in reality. Far from being a dramaturgical plan of (...) action, such utopian representations disorient the elements of discourse in order to prepare the way for the appearance of something inconceivable or inexpressible within this discourse. The theatricality produced in this oppositional public sphere—like that of Max Reinhardt, Bertolt Brecht, Ernst Toller, and later by Jean-Paul Sartre and Albert Camus—can thus be read as expressions of unfulfilled desire resisting the limitations of the present system and breaking beyond with self-defined narratives not yet realized in our everyday lives. "An English translation of Colloquium of the Seven about Secrets of the Sublime, originally written in Latin in the sixteenth-century by Jean Bodin.

O direito público contemporâneo é pensado a partir do tratamento impessoal dos cidadãos por autoridades e funcionários que agem dentro da moldura jurídica que delimita sua competência e orienta a sua ação ao interesse público. Se a soberania for compreendida a partir do instituto da propriedade (dominium), a relação entre o Estado e o cidadão acaba por espelhar a forma da relação entre senhor e escravo, em que os súditos se encontram submetidos à vontade privada do soberano. Uma tal modalidade (...) patrimonial de Estado mostra-se incompatível com a caracterização do direito público moderno. Neste artigo, identificamos na obra de Jean Bodin o contraste entre, de um lado, o caráter público do exercício da soberania nos regimes legítimos e, de outro, a natureza patrimonial dos regimes despótico e tirânico. No pensamento de Thomas Hobbes, observamos a evolução de uma concepção meramente patrimonial da soberania presente em Elements of law e De cive para uma distinção formal entre a vontade privada e a vontade pública do soberano no Leviathan. Nossa conclusão é que ambos os autores acabam por fornecer, cada um à sua maneira, um aparato conceitual apto para lidar com as características do Estado moderno acima apontadas, cuja repercussão pode ser notada na Filosofia Política dos séculos subsequentes. Este trabajo indaga la presencia de la obra de Filón de Alejandría en el Colloquium Heptaplomeres de Jean Bodin, que como otros coloquios de sabios renacentistas apunta a descubrir la “verdadera religión”, pero sin ser conclusivo. A través del personaje del sabio hebreo - su posible portavoz- Bodin recupera la visión del alejandrino de la sabiduría como develadora de armonía universal, la exégesis alegórica como “filosofar con símbolos” y el papel de la Ley, que en ambos autores (...) articula lo divino y lo humano. Proponemos que esta adopción se basa en la afinidad de intención política entre el sincretismo filoniano y el irenismo humanista. (shrink)
